PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING OR USING SAFEGUARD EACH OTHER (THE "APP"), THE WEBSITE LOCATED AT HTTPS://SAFEGUARDEACHOTHER.COM (THE "SITE"), OR ANY ASSOCIATED SERVICES, APIS, OR CLOUD PLATFORMS (COLLECTIVELY, THE "SERVICES").
THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 12) THAT AFFECT YOUR LEGAL RIGHTS.
Section 1: Critical Emergency Disclaimer & Non-911 Limitation of Service
SAFEGUARD EACH OTHER IS A PRIVATE PERSONAL SAFETY NOTIFICATION AND COORDINATION SOFTWARE TOOL.
SAFEGUARD EACH OTHER IS NOT A PUBLIC SAFETY ANSWERING POINT (PSAP), IS NOT AN EMERGENCY DISPATCH SERVICE, AND IS NOT A SUBSTITUTE FOR 911, EMERGENCY 112, 999, OR ANY OFFICIAL GOVERNMENT EMERGENCY MEDICAL, POLICE, OR FIRE DISPATCH ENTITY.
WE DO NOT GUARANTEE THAT POLICE, FIRE, OR AMBULANCE WILL BE DISPATCHED TO YOUR LOCATION UPON TRIGGERING AN SOS ALERT. IN ANY LIFE-THREATENING EMERGENCY, MEDICAL DISTRESS, CRIME IN PROGRESS, OR ACTIVE CRISIS, YOU MUST IMMEDIATELY DIAL 911 DIRECTLY.
SAFEGUARD EACH OTHER OPERATES BY TRANSMITTING NOTIFICATIONS (VIA PUSH NOTIFICATIONS, CARRIER SMS, AND OPTIONAL AUTOMATED VOICE TELEPHONY) TO THE PERSONAL INDIVIDUALS YOU SPECIFICALLY DESIGNATE AS EMERGENCY CONTACTS. WE DO NOT WARRANT OR GUARANTEE THAT YOUR DESIGNATED CONTACTS WILL RECEIVE, READ, HEAR, UNDERSTAND, OR TIMELY RESPOND TO ANY TRANSMITTED ALERT.
Section 2: Acceptance of Terms & Eligibility

Section 4: Telecommunication & Hardware Dependencies
The operation of SafeGuard Each Other depends entirely on external telecommunications networks, mobile carriers, cellular data infrastructure, Wi-Fi connectivity, GPS satellite triangulation, device operating system permissions, and third-party delivery gateways (e.g., Twilio, Firebase Cloud Messaging, Apple Push Notification service).
SafeGuard Each Other shall have NO LIABILITY whatsoever for:
Delayed or failed delivery of SMS text messages, push notifications, or voice phone calls resulting from carrier network congestion, out-of-coverage zones, or dead spots.
Inaccurate or delayed GPS coordinates resulting from atmospheric interference, tall buildings, underground facilities, or hardware degradation.
Device battery depletion, power loss, hardware damage, or device confiscation.
Operating system background process termination or permission revocation by the user.
Section 5: Acceptable Use & Prohibited Conduct
You agree that you will NOT:
Use the Services to initiate intentional false alarms, prank emergency dispatches, or harass any individual or public agency.
Use the Fake Call simulator to impersonate law enforcement, federal officers, or to facilitate illegal or fraudulent conduct.
Reverse-engineer, decompile, extract source code, or attempt to compromise the integrity of the API (https://api.safeguardeachother.com).
Submit defamatory, fraudulent, or maliciously fabricated incident reports to the Community Safety Map.
Sublease, resell, or distribute access to your account to unauthorized third parties outside of permitted Family or Team seats.
We reserve the immediate right to suspend or permanently terminate any account that violates this Section without refund.
Section 6: Evidence Vault & Legal Admissibility
SafeGuard Each Other provides an encrypted Evidence Vault designed to record and preserve audio, photographic, and video media during active incidents. While SafeGuard Each Other applies AES-256 encryption and SHA-256 cryptographic hashes to preserve media integrity, SafeGuard Each Other makes no legal representation or guarantee regarding the admissibility of captured evidence in any court of law, administrative proceeding, or criminal investigation.
Users are solely responsible for compliance with local two-party or one-party audio recording consent laws in their respective jurisdictions.
Section 7: Voluntary Medical ID & Health Information
Users may optionally store emergency medical information (such as blood type, severe allergies, and primary medications) in their SafeGuard profile. This data is encrypted using AES-256. SafeGuard Each Other is not a healthcare provider or covered entity under HIPAA. The display of Medical ID during active SOS is strictly intended to assist first responders and trusted contacts; you are solely responsible for the accuracy of stored medical details.
Section 8: Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, TIMELY, SECURE, OR FREE FROM VIRUSES OR CORRUPTION. YOU ACKNOWLEDGE THAT PERSONAL SAFETY SOFTWARE CANNOT PREVENT ACCIDENTS, ASSAULTS, CRIMES, OR MEDICAL INCIDENTS.
Section 9: Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAFEGUARD EACH OTHER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF LIFE, BODILY INJURY, EMOTIONAL DISTRESS, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF PROPERTY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE, THE SERVICES.
IN NO EVENT SHALL SAFEGUARD EACH OTHER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO SAFEGUARD EACH OTHER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).
Section 10: Indemnification
You agree to defend, indemnify, and hold harmless SafeGuard Each Other, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or related to your use of the Services, your violation of these Terms, or any false emergency alert triggered by your account.
Section 11: Apple App Store & Google Play Store Additional Terms
If you access the Services through an Apple or Google platform:
You acknowledge that these Terms are between you and SafeGuard Each Other only, not Apple Inc. or Google LLC.
Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the application.
To the maximum extent permitted by applicable law, Apple and Google will have no warranty obligation whatsoever with respect to the App.
Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms.
Section 12: Governing Law & Binding Individual Arbitration
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, or validity thereof shall be resolved through final and binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
YOU AND SAFEGUARD EACH OTHER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Section 13: Modifications & Severability
We reserve the right to modify these Terms at any time. If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
Section 14: SMS & Mobile Messaging Terms (SafeGuard Alerts)
SafeGuard Each Other LLC operates SafeGuard Alerts. You receive SMS messages only after you give your own consent for the applicable message type. Being designated as another user’s emergency contact does not, by itself, enroll you or constitute consent.
- Program description: SafeGuard Alerts delivers requested one-time security passcodes, safety check-in reminders, and user-initiated SOS alerts with live GPS tracking links. The SMS program does not include marketing messages.
- Voluntary opt-in: SMS consent is optional, separate from acceptance of these Terms, and is not a condition of purchase or subscription. A phone number entered for account or contact purposes is not blanket consent to recurring alerts. Account holders and emergency contacts must each affirmatively consent before receiving their applicable messages. Requesting a one-time passcode authorizes that requested verification message, not enrollment in other SMS programs.
- Message frequency: Message frequency varies with requested account verification, safety check-ins, and user-initiated SOS events.
- Message and data rates: Message and data rates may apply. Consult your carrier for your plan details.
- Delivery and carrier liability: Delivery depends on carrier coverage and network availability. Carriers are not liable for delayed or undelivered messages. SMS delivery is not guaranteed, and SafeGuard is not an emergency-dispatch service.
- Opt out: Reply STOP to opt out at any time. After STOP, a single confirmation message may be sent; subsequent program messages stop unless you opt in again. Text START to re-subscribe where supported. You may also contact support to request removal. Opting out of SMS does not cancel your paid subscription; manage subscriptions in app settings or My account.
- Help: Reply HELP for help, email [email protected], or visit our contact page. In a life-threatening emergency, call 911 directly.
- Privacy: Read our Privacy Policy. Mobile information is not shared for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with third parties.
Opt-in disclosure and evidence: This section explains the SMS program; it is not an enrollment form. For opt-in within the mobile app, carrier reviewers need evidence of the actual consent screens for account holders and emergency contacts, including the optional consent control and disclosures shown before enrollment.
